1) I do think the biggest motivation of the movie making you think they were flashbacks was so they could have twist ending. On the other hand you can say that the movie is trying to make you experience time the same way the aliens do. Of course, if you really want to watch a movie that way, the movie that takes that approach to extremes is 21 Grams.

2) I did question about what the movie thinks about free will. I don't think it's clear and it does make a big deal as to the choice she makes.
