Couple of quick thoughts:

1) Let's not forget that Flynn is a former Lt. General and not some political hack. I think it's entirely possible he was free-lancing as he has such a large pre-Trump Russia connection AND a known history of bumblefuckery.
2) The "He Doesn't Have To Leave Until Caught" does seems damning on the surface, but then again, the levels of disconnect and discord amongst the team could always mean that the "Don't see conspiracy when ineptitude would also do" rule may apply.
3) Pence feels ALL over this. He may be making an early play to establish power positions.
