I'm not sure it isn't a hardship, but it's still apples and oranges. You have to file tax returns, for instance, even if you don't owe taxes, to

satisfy your legal obligation to pay taxes or evidence that it isn't required. There are a number of things like that. But that is wholly different than imposing restrictions on someone's constitutional right. Frankly these things should be slam dunks for being overturned as unconstitutional (and several have been), however, judges still seem (like many here) to get caught up in the "common sense" of it, rather than looking at the factual basis for it.
