To recap: Costco bought some golf ball overstock from a manufacturer in Korea. Turns out what they bought was a surplus of high quality TaylorMade golf balls. The manufacturer had made too many and sold off the excess. Costco sold them at cut-rate prices and since they were basically TaylorMade balls, they were reviewed favorable.
Titleist isn't happy. They say Costco's marketing of the balls as being high quality is deceptive and that the balls infringe on Titleist patents, but since Costco didn't manufacture them, who's responsible for the infringement?
Costco's gone to court and asked for a pre-emptive judgement.
