Will, I think 'theft' is a bit far. It's not like the airline keeps the money and never flies you.

They put you another flight with space. No, it's not your original flight, but you get the travel you paid for, just at different time (again as spelled out and allowed in the CoC you agree to at purchase) so it's not theft. Otherwise, flight delays would be 'theft'.
Again, not defending it. We have no power in this because we can't buy the ticket without agreeing to the CoC and every airline has this stuff in their CoC. And we have an airline oligopoly in the US to book. So not defending. But 'theft' feels a bit overboard.
The other thought: Airlines now a certain % of people will no-show. They factor that in. If they can't sell those additional tickets an only sell 100% of seats, than fares rise.
