ignore statements that are applicable to intent when intent matters. I agree with your point 2 and the dissent's comment that essentially asks if every action the president takes is then tainted by his prior statements. I don't think there is an easy answer to that. But when candidate makes statements and it is literally one of the first things they act on, it is extremely hard to separate the 2.
