House Forced to Hold Another Vote to Pass Tax Bill After Hitting Parliamentary Hurdle

Republican plans to pass a $1.5 trillion tax cut by Tuesday hit a snag when the Senate's parliamentarian advised that three provisions in the legislation would run afoul of the fast-track procedures that govern the tax bill, forcing a revote in the House.

The three provisions -- including one that would allow people to use money from tax-advantaged college savings plans to pay for elementary and secondary school expenses related to home schooling -- would need to be struck from the bill unless Republicans can muster 60 votes to preserve them, according to Sen. Bernie Sanders (I., Vt.), who holds the top spot for Democrats on the Senate Budget Committee.

"We applaud the parliamentarian for determining that the three provisions in this disastrous bill are in violation of the Byrd rule," Mr. Sanders said in a statement. "It is our intention to raise a point of order to remove these provisions from the conference report and require the House to vote again."

House Republicans immediately scheduled a new tax vote for Wednesday morning in order to pass legislation identical to the version that is expected to pass the Senate as soon as Tuesday night. Senate Republicans control only 52 seats, compared with 48 for Democrats, leaving Senate Majority Leader Mitch McConnell (R., Ky.) with little choice but to strike the provisions, which Democrats had opposed.
