It looked a whole lot less on the video like "person stepping out into traffic" than "person in street"

the argument there is the car *should* be able to see that better than a human in the dark and brake well ahead. I mean, there was a whole lane to the left of the person and they were moving from left to right across the lane. Car sensors should pick that up especially with that much free road in front.
