probably not but really the argument is two-fold

1) The human safety driver wasn't following protocols. They clearly were looking down at a phone instead of being ready to drive. While it may not have saved them, at least attempting to slam on the brakes might have done something
2) The car has the ability to react better than a human. It didn't react at all in this case which made it profoundly worse.
