The comments seem to suggest that the photographer was in the wrong because he took a picture of someone's art (statue) for sale. Getty was wrong to

sell it (misattributed) and the Post Office wrong to use it. Presumably the Post Office could now go sue Getty and/or the photographer to recover these damages.
