Per Dawson above, doesn't look like NY is. Whether it's privileged depends on what's on the tapes. They have a system for having an administrative

judge go through all the materials and determine what is privileged and what is not before handing it over to investigators. There is a story today that the judge determined that 4,000 documents Cohen and Trump claimed privilege for, are not.
