Disney owns the characters. Fox has the exclusive license to use those characters for certain media.

Disney owns Fantastic Four. Fox only has rights to do movies for some period of time, I have no idea how long the contract is for. -- nm

I believe the original contract with the people who rushed the 90s movie in to production was that they kept the rights in a sort-of perpetuity...

Yes, semantically, that is correct. Studios only have rights to produce movies on properties they licensed from Marvel (Disney).
