I believe the original contract with the people who rushed the 90s movie in to production was that they kept the rights in a sort-of perpetuity...

As long as they made a movie every X number of years (ten, if I recall correctly). Which is why they needed to get the 2000s version and the 2010s version on screen in a certain timeframe. Fox needed to get the Alba-led version in to production within ten years of the end of production of the 90s version, and the 2016 needed to be in production within ten years of the end of production of Silver Surfer.
