Actually, he was the intended victim.

If I am reading it right, the guy who was killed lived at his old address. The guy who actually did the swatting was basically a swatter for hire and he was sentenced to 20 years for his various crimes.

Yes - though an added detail: Viner threatened to swat Gaskill, and Gaskill gave his old address and said "I'll be waiting"

He's mostly the victim, so I guess deferred prosecution is OK. The guy who ordered the swatting got probation. While the guy who made the call...
