They are banking on the idea that they've slowly moved the bar to "every element has to be on tape, with absolute certainty of unambiguous meaning" to

constitute evidence of a crime. He's arguing that he is concerned about corruption (side note: Ha!). That he doesn't explicitly offer a quid pro quo, etc. So he'll argue that the evidence supports him. He's had an uncanny ability to gaslight America and he's counting on just continuing to do that.
