Yes I mean obviously the scope of the situation is up to humans that’s a non sequitur and applies to anything and everything in the constitution

The point is that people as this author seems to recognize will be less willing to venture outside a workable standard — as they should be and as they will be because they are lawyers and judges
As for post independence - there’s a very clear legal principle that if a subsequent congress passed a law to clarify this or that it must mean they thought the prior existing law didn’t do it and so did all the states that ratified the 25th amend
