If that’s your metric then we return to my point.
It anything is possible under that rubric
Chief Justice John Roberts is never going to agree that the congress has unfettered discretion to pass articles of impeachment based on you insulted the nation, or anything that the impeachers cannot tie to the text and structure (ie look at other amendments) of the constitution
You’ve gone from the realm of “yeah politicians will do whatever they want” (true enough) back into “will this stand up in this court” (the notion that it will ignores the very partisanship you’re otherwise pointing at in addition to legal arguments)
