What would be the basis for charging/jailing them?

(not a challenge, just a question)
That they put out a plane with known flaws (over some threshold that a 'logical person' would accept, since flying by its nature hold risk)?
Or that they didn't ground the fleet after the first crash?
Or some combo thereof?
I hadn't thought of criminal impacts before so I'm curious.
