It was in my dad's name as the primary account holder.

Her name was also on the account since she had to do the finances which he's no longer able to do for himself.

It doesn't. What you want, ideally, is a power of attorney for your dad, and then to be listed as such in the account title.

(Although, that said, you may be able to successfully argue that the garnishment took money that wasn't hers, was your dad's, and get it restored.)
