It helps their case in front of the judge to keep them from enforcing the subpoenas. Different court, different argument, but it looks bad for

essentially the same party to take different positions in this circumstance. It's the knot they've tied themselves into because they don't care about consistency or logic. They just make arguments and see what sticks.
