Right, but as you see this isn't really variable billing for basically an ER visit, as it ends up in the same place as any other visit

I thought you were using it as a proxy for showing price gouging, which does exist and is a huge problem obviously
but if it's about variance in ER visits, it ends up in the same place if you have insurance
MY point is that the problem is the lack of universal insurance or a public option, not really this particular incarnation of it
It's great that prices are not unilaterally set, the point about price control stands: it can and does lead to anomalous results and unexpected costs that have to be planned for or taken into account in other ways. It's a far preferrable system, in fact probably the only preferrable one, but it's along way from being completely rational, as price controls never are
