You don’t have to be franchised. I don’t believe SS franchises and neither does Ruth’s Chris. -- (edited)

If you are a franchisee you’re already a separate employer. There’s no need for this provision. This is for big restaurant groups so they qualify for the provision.
I believe the argument the industry made was to basically treat restaurants that franchise and restaurants that don’t equally but it was really just a way to get a bailout.
