That’s at least a policy to be argued about. 2/3 of his cabinet have been let go for ethic issues or were terribly unqualified upfront.

He got 85 votes for confirmation and hasn’t been nailed with ethics charges or been forced out.
That qualifies as a valid cabinet member.
