No, you're simplifying the case and not getting into a gray area.

You killed a man. You go to prison for a very long time.
Simple.
You killed a black man cuz you hate blacks. You go to prison for a long time.
Simple.
You killed a black man cuz you hate blacks. You go to prison a long time + 10 years cuz you have evil in your heart.
I'm pretty sure that you killed the man is the evil that's not legal; not hating blacks.
Hell, that dude who shot up the Holocaust Museum, do you not agree he had the right to hate Jews, blacks etc etc? If he has that right, his only crime was shooting up the museum and killing the man.
That's murder. It's illegal.
Let's not complicate the scenario when the crime is right there in front of us. He shot a man and killed him. Put him in prison till he rots.
The world isn't rainbows and puppy dogs, and quite frankly, the moment we stop trying to make people think that, the better we'll be able to get along. No one's special, no one's unspecial.
Kill a white, a black, a immigrant, a muslim, a abortion doctor, a white supremacist...it's murder. If our system works as well as we say it is, that killer is off the streets (permanently) and we haven't touched the gray area.
