This ties in to my big concern with this.

I don't see the Dems able to get that liberal of a court, in part because I think they would usually go for more middle of the road judges. Part because that's how some of them lean, partly because that's who they think they can get confirmed.
Meanwhile the Republicans would seat the most conservative justices they could and get as many cases before them as possible. And once they get RvW overturned, the single issue voters would keep them in power for good. They couldn't risk letting a more liberal court happen.
