Oh, I get that. I'm not at all trying to argue a trailer isn't an advertisement.

With the Beastie Boys and the licensing of their music for a film, I'm not sure if they can say you can use it in the film but not in the trailer for the film.
That's why I say it's used indirectly. They didn't sell them the music just for the advertisement/trailer.
