It's Trump's stupidity ... he thinks that's what happened in 2000 but the legal issues were quite different and mostly "legitimate".

Which is not to say 2000 wasn't a travesty, but the key difference between the 2 situations is that this year there appears to be no basis for a case. He doesn't realize that's the key driver. He thinks the SC just intervened in 2000 and so they should do it again. He's really not smart about most things other than branding strategy.
