I think that if he thought the law really applied to him, that would be the case. But, he has said repeatedly that he believes he has the power to -- (edited)

pardon himself. I also think that his vanity won't allow him to resign and I don't know if there is a guaranty that Pence would agree to it. I'm guessing he has his eyes on the office and given how that played for Ford, I don't know that he'd want to take a potentially polarizing position on this point.
