arguably not. two of the tests for these cases are length of time the trademark has been used without confusion, and likelihood of confusion.

Notre Dame has done this several times, and I don't think it's ever been tested in court. schools back down, because they don't have the resources to fight it, but there's a not insignificant chance they could win if they did.
