I don't think that argument would hold up. The intent was to not have someone serve more than two terms but acknowledging that you shouldn't be

shorted by talking over for a deceased or retired president. If you've already been elected twice, that fulfills the intent of the amendment and I would think most courts would rule 'nuh uh'.
