Prosecutors and defendants make last minute deals before verdicts often enough, I wouldn't say a pardon at that point is anything extraordinary.

Accepting its existence as intended for noble purpose, if it was felt the trial itself was an undue burden or unjust for the defendant, a pardon should be used promptly no matter how far along prosecution is.
