most of the 2nd tier are there becuase of the stars who get nominated for the event, which puts them there already.

Ledger = Dark Knight
Vicky Christina = Penelope?
Downey Jr = Tropic Thunder
Rourke = The Wrestler

this just waters down the entire value of the category
