Supreme Court declines to hear he Cablevision case ("networked DVR" thingie). Either way, this inches us closer to a new fair-use case.

Appeals court ruled that the Cablevision DVR was little different than a VCR (basically citing and thus reinforcing the Betamax ruling which made recording of TV shows legal). The next piece of the puzzle is the question of whether we can legally "backup" and "record" flagged and/or copy-protected content for private use.
