I think the biggest issue is that there's no precedent for prosecuting something like this. Where the line is between presidential authority and

illegal abuse of that authority may not have a clear test. You don't want to bring this case if you think there's a good chance you'll lose. That's where I think it gets tricky. I think you could definitely make a conspiracy case for abuse of power, but I'm not sure what law exactly is touched on or if we're really looking at massive breaking of norms (which begs legislation to stop it in the future).
