Transfer before he loses his case. That’s not how things should work so good for them?

Yes, this is standard procedure unless the argument is so obviously a loser that they don't think it has any chance at winning. This is fairly unique

He shouldn't win (and I don't think he will), but it's a fairly unique set of facts and arguments so there was no way a court would turn it down
