While this is very true, it doesn't really matter. If it were overheard by someone else then that person could file the complaint.

The woman may not care, they could be joking around and she may be 100% okay with it. But Suzie who overheard it isn't okay and files the complaint. That's how it works now. You have to be careful with not only what you say to someone, but with who may overhear what you say. And it's been like that for a long time. I remember being told that at least 10 years ago.
