spitballing here, but I believe it can really depend on the employer's policies

similar to what can be done for retirement plans. They could exclude classes of employees like temporary workers (which they could put seasonal into). They could also, I believe, require a minimum hours threshold for qualifying for the benefit (most 401ks for instance have a 1000 hour rule for eligibility)
