Sure inciting a seditious insurrection and other charges would be sexier, but extremely difficult to prove in court.
This is pretty straightforward. The only defense I can really see is the FBI planted them argument. They knew he had these documents long ago and established an extensive history of trying to have them returned voluntarily. It's a pretty uncomplicated case on the evidence. Even if there was no malice involved it's still a crime.
He had these documents illegally. Multiple attempts were made to have them returned voluntarily. He kept them illegally.
