It is no easy thing to be a "judge"

the lack of qualifications and seasoning becomes apparent in things like this. As a judge you don't get the easy things. You get the things that have legitimate arguments to support them. Now some arguments are barely legitimate and most judges will make sure to destroy those. The appeals courts, however, are incredibly smart well reasoned and have the benefit of deciding legal issues. A District Court has the rough and tumble of live testimony and evidence and argument and things can get complicated and difficult fast. No excuse but mistakes happen in live hearings where split second dicisions are made.
