and if he chooses to pay the fine vs paying people, that money goes to the fed, right? not to the employees? so he's like choosing doubly to screw

Right. There’s two legal actions here. An employee class-action (employees get paid if they win) and a federal (and/or state) action (gov’t gets $$) -- nm
