a 1970 law says Congress is back in session at noon on Jan 3 of every odd numbered year following an election

so Congress is in session, it just has no sworn members yet

so it not that the House doesn't exist, the House just can't do anything until they get members

so we're bicameral already, just one side isn't ready to work
