That's not really the case. The difference of knowledge, intent and the obstruction that essentially proves both is the key. Typical DOJ standards

It's always been the case that Trump's situation was different. They asked him to return the stuff and he refused until they had to go get it. Biden never argued, made everything available and fully cooperated. That's the difference.
