An off-duty Department of Public Safety trooper who shot a man for allegedly trying to break into his apartment is going to face a grand jury, according to the Harris County District Attorney's Office.
The shooting occurred right after midnight on Monday on the fifth floor of the apartments on the 500 block of Crawford Street, near Minute Maid Park downtown.
The Houston Police Department said the trooper, whose name has not been disclosed, told police he believed a man was trying to break into his apartment. The trooper told police he made "several commands," telling the man to "get away," while the alleged intruder was trying to break into his apartment.
According to the Houston Police Department, the trooper discharged his weapon one time and struck the alleged intruder in the right shoulder. Police said the alleged intruder left the apartment after being shot, but police soon located him, provided medical attention, and transported him to a local hospital.
The man who was shot was identified as a Black man in his 30s and he was expected to live.
Houston Police Department officials said the man who was shot lived in the same building as the trooper.
A spokesperson for the apartment's ownership group, Finger Companies, told ABC13 they believe the man who was shot may have mistaken another apartment's as his own. ABC13 also reported that the two men lived in units that ended in the same two numbers, one floor apart.
A spokesperson for the Harris County District Attorney's Office said they will present the case to a grand jury as they do with any shooting involving law enforcement. Police did not immediately charge the injured man.
