IMO: If someone hums or sings the song and isn't doing it on purpose to knock you out and doesn't know you're playing, it counts.

My BIL was being a dick about it during Thanksgiving weekend. He knows I play and was just being annoying about playing the song even after I told him it wouldn't count since he's doing it on purpose knowing I'm playing.
