Those are fantastic questions.


That is one key difference between a state supreme court and a Secretary of State -- like Secretary of State Shenna Bellows in Maine.

The Supreme Court of Colorado issued a legal ruling; the Secretary of State issued more of an "administrative ruling" based on her own interpretation.

The Supreme Court of Colorado reviewed an appeal from a lower court's decision; the Secretary of State took up the matter on her own.

The SCOTUS ruling should cut off all further appeals, but they could decide something weird. For example, they could rule that the Colorado trial court didn't sufficiently review all the evidence or that the lower court's decision was flawed from the beginning -- which could kick the can down the road.

A more pragmatic decision would be that he cannot be excluded from the ballot, but even if elected, he could not serve in office. That's the sort of needle-threading SCOTUS has been doing lately.
