If I’m reading right, he gave the relief on a thing that might disappear at any time so would that basically render his ruling moot and the rule is

Effect if the entity is deemed viable by Scotus?
Like a fuck you 5th for rushing me - here’s the easily destroyed basis for ruling instead of other avenues to appeal if that happens?
