The onus is on the prosecution to play by the rules, which state the defendant is innocent until proven guilty. By playing fast and loose

with evidence, they've broken the trust of the system and corrupted the entire process.

That penalty is they lose the case, and have to face the possibility of being held to account in the public eye for failing the victims.
