will be tougher, but I expect that if Trump isn't president, people will have a harder time arguing against limiting presidential immunity (the realization that the "other guy" has those powers is scarier). Code of ethics is also hard to argue against in good faith. Not that I expect good faith, but it is just more transparent in that case.
