IANAL, but shouldn't he have called for a new trial? It seems odd that after the case the judge can decide he doesn't like the jury's decision and can -- (edited)

just toss the whole thing. Seems shady to not go back and either try the case again or adjust the judgement so it's more in line with the testimony of the expert.
To throw it all out seems wrong.
