Musk wants to be above the law, simple as that. At least when he doesn't agree with those in power. It has been pointed out that he was fine with taking down content that simply badmouthed Erdogan or Modi, but is deadset against taking down content that falsely contests election results, for instance.
Moraes, the judge doing this, is the one that got the case to persecute the idiots that thought they were doing our tropical version of Jan 6th (the Congress invasion on Jan 8th, 2023), as well as what is called the fake news digital militias. This is all part of that effort, and since Musk doesn't like Lula, he is trying his damnest to put obstacles.
FWIW, I have not read one single legal expert who thinks that the Xitter ban is not legal and warranted. They disagree with some ancillary measures (such as the VPN thingie, which is something he already used in the past), but not with the headline. It may not be politically savvy, but it is (despite what Musk may say) perfectly legal.
